Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the SkyeFire website and products provided by SkyeFire US LLC (“SkyeFire,” “we,” “us”). Please read them carefully.
01Acceptance of Terms
By accessing or using the SkyeFire website or any SkyeFire product, you agree to be bound by these Terms. If you are using the services on behalf of an organization, you represent that you are authorized to bind that organization, and “you” refers to that organization.
If you do not agree to these Terms, do not use the services.
02Eligibility
You must be at least the age of majority in your jurisdiction and legally able to enter into a contract to use the services. The services are not intended for use by children.
03Accounts & Responsibilities
Some products require an account.
- You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your credentials.
- You are responsible for activity that occurs under your account.
- Notify us promptly at skyefire.ramsey@gmail.com of any unauthorized use or suspected compromise.
04Acceptable Use
You agree not to:
- Use the services in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to the services, other accounts, or our systems, or to disrupt or degrade the services.
- Reverse engineer, decompile, or attempt to extract source code except to the extent permitted by law.
- Upload malicious code, or misuse another party’s data or personal information.
- Resell, sublicense, or commercially exploit the services except as expressly permitted.
05Early Access, Beta & Demonstrations
Several SkyeFire products are in active development and offered as early access or beta. Features may change, and availability, performance, and data continuity are not guaranteed during these phases.
- Evolving features. We may add, modify, or remove features as products mature.
- As-is basis. Early-access and beta features are provided “as is” for evaluation and feedback.
- Demo materials. Data, figures, and dashboards shown in demonstrations are illustrative and do not represent any specific customer unless expressly stated.
06Intellectual Property
The services, including software, text, graphics, logos, the SKYEFIRE name and marks, and all related intellectual property, are owned by SkyeFire or its licensors and are protected by law.
- We grant you a limited, non-exclusive, non-transferable, revocable right to use the services in accordance with these Terms.
- You retain ownership of content and data you submit. You grant us the limited rights needed to operate and provide the services to you.
- You may not use our marks without prior written permission.
07Third-Party Services
The services may link to or integrate with third-party services. We are not responsible for third-party content or practices, and your use of them is governed by their terms.
08Disclaimers
To the maximum extent permitted by law, the services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the services will be uninterrupted, error-free, or secure, or that defects will be corrected. This is particularly true of early-access and beta features.
09Limitation of Liability
To the maximum extent permitted by law, SkyeFire and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the services.
To the maximum extent permitted by law, our total aggregate liability arising out of or related to the services will not exceed the greater of the amounts you paid to us for the services in the twelve months preceding the claim, or one hundred U.S. dollars (US$100).
10Indemnification
You agree to indemnify and hold harmless SkyeFire and its owners and personnel from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the services or violation of these Terms or applicable law.
11Termination
We may suspend or terminate access to the services at any time if you violate these Terms or to protect the services or other users. You may stop using the services at any time. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
12Governing Law & Disputes
These Terms are governed by the laws of the State of Nevada, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Nevada will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the services, and you consent to their jurisdiction and venue, except where prohibited by applicable law.
13Changes to These Terms
We may update these Terms from time to time. We will revise the “Last updated” date above, and material changes will be effective when posted. Your continued use of the services after changes take effect constitutes acceptance.
